GIVEAWAY DEFINITION: The Green With Envy Giveaway – Green Amethyst Jewelry from Brindle & Figg ("Giveaway") is a sweepstakes as defined by law; no purchase or fee is required to enter with the winner selected at random from all qualified entries
GIVEAWAY TIMING: The Giveaway begins at 12:00 a.m. Eastern Time on 09 October 2020; ends at 11:59 p.m. Eastern Time on 15 November 2020 ("Giveaway Period").
ELIGIBILITY: Persons who are 18 years of age or older (or the age of majority in their jurisdictions of residence, whichever is older) as of the date of entry ("Entrant").
Employees of Brindle & Figg LLC (“Sponsor”), Capua Advisory Services LLC ("Administrator"), their affiliates, subsidiaries, advertising and sweepstakes agencies and immediate family members (spouses, parents, children, and siblings and their spouses) and household members of each (whether related or not) are not eligible to participate or win the Prize.
Void where prohibited or restricted by law. All applicable laws and regulations apply.
HOW TO ENTER: There are two (2) ways to enter the Giveaway, as stated below:
Via Website: During the Giveaway Period, visit https://gleam.io/xXq8y/brindle-figgs-green-with-envy-giveaway ("Website") and follow the instructions to enter the Giveaway.
Via the United States Postal Service Mail-in: Mail a postcard or letter with your handwritten: email address, first (given) name, last (family) name, mailing address including PO Box number or street name and number (including apartment, suite or unit number, if applicable), city, state (or province/territory), zip code (or postal code), country and one or more valid phone number(s) where you can be reached and mail to Brindle & Figg, PO Box 11101 Charlotte NC 28220-1101 USA. Entries must be received by the end of the Giveaway Period. Neither Sponsor nor Administrator responsible for mail-in entries which are undelivered, misdelivered, delivered late, damaged, mutilated or illegible.
Automated Entries are prohibited and use of any automated or computer system to participate is prohibited and will result in disqualification, if detected, of all Entries by such an Entrant.
Normal Internet access and usage charges imposed by your online service may apply. If participating via mobile device, standard phone data rates and usage charges imposed by your phone service provider may apply.
All Entries shall be the property of the Sponsor and will not be returned.
In the event of a dispute over the identity of an Entrant, Entry will be deemed submitted by the Authorized Account Holder of the e-mail address, postal address and/or social media account registration associated with the Entry and solely determined by the Giveaway Administrator.
PRIZE AND ACTUAL RETAIL VALUE ("ARV"):
Princess Cut Green Amethyst Stud Earrings: matching pair 9mm Princess cut AAA green amethysts (8.25ctw) cage set in solid 18 karat yellow gold. ARV is US$1,490.00
Winner is solely responsible for all federal, state and local taxes, including applicable duty, associated with Prize acceptance.
Actual/appraised value of any items purchased at brindleandfigg.com or any of its retail partners may differ at time of prize award.
The specifics of the prize shall be solely determined by the Sponsor.
Sponsor may, at its sole discretion, at any time during the Giveaway Period, add prizes and/or increase the number of winners from the eligible entries received if the Sponsor believes that doing so will increase the chances of each entrant winning a prize and/or increase the value of the prize(s) available to each entrant. These include, but are not limited to, awarding additional Prizes or creating “second place” and “third place” prizes in addition to the aforementioned Prize(s). Entrants will be notified via email of any such addition of prize(s) and/or increase in number of winners, and the consequent change(s) in rules reflected on this page.
Prize is not transferable or assignable.
No substitution or transfer of the Prize is permitted, except that Sponsor may substitute prize component of equal or greater value for any reason.
Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor.
EARLY TERMINATION OF GIVEAWAY: Sponsor reserves the right to terminate the Giveaway prior to the end of the Giveaway Period without awarding any Prize if the Giveaway has failed to generate a sufficient number of qualified entries (deemed to be 1,500 total).
RANDOM DRAWING: The Prize winner and two alternate winners will be selected in a random drawing, conducted on or about 16 November 2020 from among all eligible Entries received throughout the Giveaway Period.
Drawing will be conducted by the Administrator at their offices in Charlotte North Carolina USA whose decisions are final on all matters relating to the drawing.
Odds of winning are dependent upon the number of eligible Entries received throughout the Giveaway Period.
WINNER NOTIFICATION/VERIFICATION, ALTERNATE WINNERS: The entrant randomly selected as the Prize winner will be notified via the contact information provided on the Entry as submitted and will be required to sign and return an IRS Form W9 (for residents of the United States only), an Affidavit of Eligibility & Liability Release, and where legal, a Publicity Release within seven (7) days of notification attempt.
In the event that the entrant selected as Prize winner fails to respond within seven (7) days or is otherwise disqualified for reasons stated in these rules that entrant will forfeit the Prize, and the entrant randomly selected as first alternate Prize winner will be notified and be required to respond with the affidavits and releases within seven (7) days in a manner identical to the one described above. Should that entrant fail to timely respond otherwise be disqualified, the same process will devolve to the entrant selected as second alternative Prize winner. Should the Prize winner and both alternate Prize winners all fail to timely respond and/or be disqualified, the Sponsor reserves the right to randomly select more potential prize winners or terminate the Giveaway with no Prize being awarded.
GENERAL RULES: By participating in this Giveaway, Entrants agree to be bound by the Official Rules and the decisions of the Sponsor.
By accepting the prize, winner agrees that the Sponsor and those acting under the Sponsor's authority may use winner's name, picture/portrait, likeness, and/or hometown, for advertising and promotional purposes without further consideration, unless prohibited by law.
By accepting the prize, winner agrees that Sponsor and their subsidiaries, affiliates, advertising and Giveaway agencies, including the Administrator, and their directors, employees, representatives and agents, will have no liability whatsoever for, and will be held harmless by winner for any liability for any injury, loss or damages of any kind to persons, and property damages sustained, due in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of prize or participation in this Giveaway or any prize-related activity.
The Sponsor is not responsible for any typographical or other error in the printing of the Giveaway materials or the offering or announcement of the prize.
If for any reason the Giveaway is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Giveaway, Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the Entry process, and to cancel, terminate, modify or suspend the Giveaway.
Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entry.
Sponsor is not responsible for: (a) incorrect or inaccurate transcription of Entry information or late, mistranscribed, delayed or incomplete Entries received through impermissible or illegitimate channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, website, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any website or service; (d) unauthorized intervention in any part of the Entry process or this Giveaway; or (e) printing, typographical, electronic or human errors which may occur in the offer or administration of this Giveaway or the processing of Entries. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
DISPUTES: Entrants/winner agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Giveaway, or the prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively by the United States Federal Court for Charlotte, North Carolina or the appropriate State Court located in North Carolina in the U.S.; Entrants/winner submit to sole and exclusive personal jurisdiction to said courts exclusively in the United States Court for Charlotte, North Carolina in the U.S. or the appropriate State Court located in North Carolina for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Giveaway but in no event attorneys' fees; and (c) under no circumstances will Entrants/winner be permitted to obtain awards for and Entrants/winner hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants/winner or the Sponsor and its agencies in connection with this Giveaway shall be governed by, and construed in accordance with, the laws of the state of North Carolina in the U.S., without giving effect to any choice of law or conflict of law rules of provisions (whether of the state of North Carolina, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of North Carolina in the U.S.
DATA COLLECTION/PRIVACY: Sponsor collects personal information from Entrants when they enter the Giveaway for use in administration of the Giveaway. The information collected is subject to the Privacy Policy located at https://www.iubenda.com/privacy-policy/25133270. By participating in the Giveaway, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy. The Sponsor will only use your personal data for the purposes of administrating this Giveaway and for future marketing and advertising purposes unless you provide consent signifying your agreement to any other processing or use of your personal data.
